Fair Work Amendment (Paid Family and Domestic Violence Leave) Act 2022

A new form of paid leave has been introduced to support employees experiencing family and domestic violence. Family and domestic violence is when one person in a relationship harms or controls another through physical, psychological, financial, or sexual abuse. In Australia, one in six women and one in 16 men experience this type of violence, often while maintaining employment.

Paid family and domestic violence leave allows employees to take up to 10 days off in a 12-month period to manage the impact of the abuse, without risking their income or job. This includes attending court, accessing police services, or ensuring their safety.

All employees, whether full-time, part-time, or casual, are entitled to this leave, and it applies to small businesses covered by state and national industrial relations systems. For casual employees, the leave covers the hours they were rostered to work.
